Read the front matter of U.S. Patent 3,541,541 and the arrangement of the entire industry is right there in a single line: "Douglas C. Engelbart, Palo Alto, Calif., assignor to Stanford Research Institute, Menlo Park, Calif." Engelbart is the named inventor. But that word *assignor* is doing all the work. Under U.S. patent law, it means SRI—not the man who dreamed up the device—held title to the invention. When the mouse eventually became one of the most licensed pointing devices on Earth, the royalties flowed to the institute. Engelbart, by his own account, never saw a cent.
The patent, titled "X-Y Position Indicator for a Display System," was filed on June 21, 1967 and issued on November 17, 1970. It describes not a mouse but a mechanism: a small box that a hand could slide across a desktop, with two wheels set at right angles that tracked motion along the X and Y axes and translated it into a cursor's movement on a screen. The name "mouse" never appears in the legal document. It came later, from the lab, because the cord trailing out the back looked like a tail.
How the mouse got built—and who owned it
Engelbart didn't build it alone. According to the Association for Computing Machinery's 2013 obituary marking his death, the device was developed with lead engineer Bill English at SRI's Augmentation Research Center, the same lab that staged the 1968 public demonstration now remembered as "the Mother of All Demos." The mouse was one piece of a far larger vision: Engelbart wanted to augment human intellect, to let people think and collaborate with machines in real time. The pointing device was a means to that end, not the end itself.
That distinction matters for understanding why the money went where it did. Engelbart was an SRI employee doing SRI-funded research, so the resulting patent belonged to SRI. This is the ordinary bargain of institutional science, spelled out in the patent's own language. The invention was real; the ownership was contractual.
Why Engelbart earned no royalties
The commercial afterlife is where the arithmetic stings. Writing in 2013, the intellectual-property blog The IPKat quoted Engelbart directly: SRI patented the mouse and licensed it to Apple for about $40,000. The IPKat also notes the patent was granted in 1970 and expired in 1987—which means that by the time the mouse became ubiquitous on desks in the late 1980s and 1990s, riding the Macintosh and then Windows into hundreds of millions of homes, the patent had already lapsed. There was nothing left to license.
So the window in which the mouse could earn patent royalties was narrow, and it closed before the personal-computer boom made the device essential. The ACM obituary records Engelbart's own summary of the outcome plainly: he said he never received royalties from the invention. The roughly $40,000 Apple paid went to SRI, and it was paid for a technology that would help sell computers by the millions.
Engelbart did not spend his life bitter about it, at least not in the record he left. His attention stayed on the larger project—shared workspaces, hypertext links, the collaborative computing he'd sketched decades before the tools caught up. The mouse was a footnote to him in a way it never was to the industry.
What's still worth arguing about is the fairness of the whole arrangement. The institutional-assignment model that left Engelbart with nothing is exactly what funds the labs where inventions like his get born. Was the bargain a robbery or the price of the research? The patent itself won't tell you. It only records, in cool clerical prose, that the man who made the mouse gave it away the day he signed on.
